CFTC Application Rejected CME Regulatory Litigation Against Crypto Perpetual Contracts

According to CoinMeta, Wu said that he learned that the U.S. Commodity Futures Trading Commission (CFTC) has applied to dismiss a lawsuit filed by the Chicago Mercantile Exchange (CME) regarding the regulation of crypto perpetual contracts. CFTC argued that CME lacks the jurisdiction to file the lawsuit, as current policies also allow the listing of digital asset perpetual futures. The so-called competitive harm cited by CME is partly due to its own choice not to offer such products. Even if the court reclassifies perpetual contracts as “swaps” rather than “futures,” other trading venues can still continue to provide similar products, thus it would not be possible to eliminate the competitive harm mentioned by CME.
