SEC Update on Cryptocurrencies FAQ: Token Buybacks Without a Central Party Do Not Constitute an Investment Contract

According to CoinMeta, as reported by Eleanor Terrett, the U.S. Securities and Exchange Commission (SEC) has just updated its frequently asked questions regarding token repurchases. The new provisions state that if there is no central entity supporting these token repurchases, such arrangements may not constitute an investment contract. This update follows comments made last week by Miles Jennings, the SEC's Chief Legal Counsel and Policy Officer, who noted that previous wording might have allowed issuers to announce repurchase plans without those announcements constituting an investment contract.
