According to CoinMeta, as reported by Bitcoin News, CFTC has requested the District of Columbia Court to dismiss the lawsuit filed by CME against Kalshi regarding bitcoin perpetual futures. The BTC Perp contract, which settles in cash, was approved on May 29th with no expiration date and adopts a funding rate that tracks the spot price. CME believes that contracts without a delivery date and that involve continuous payments are classified as swaps rather than futures. CFTC views this matter as "making a mountain out of a molehill," pointing out that CME could also list similar products, and that the trading volume for bitcoin futures in June and August was higher than in May. CME is required to submit a response by October 2nd.
