Hyperliquid Policy Alliance Submits Amicus Curiae Brief to U.S. Courts

According to CoinMeta, the Hyperliquid Policy Alliance ( HPC ) submitted an amicus curiae brief to the United States District Court for the Federal District of Columbia, supporting the decision of the Commodity Futures Trading Commission ( CFTC ) to dismiss a lawsuit filed by the Chicago Mercantile Exchange ( CME ) against perpetual futures on regulated US exchanges. HPC stated that in May of this year, it allowed Kalshi to launch Bitcoin perpetual futures and confirmed that US derivatives exchanges could list similar perpetual contracts for digital assets. CME subsequently filed a lawsuit challenging these decisions. HPC argued that CME failed to prove that the decisions of CFTC caused them actual harm, therefore lacking the jurisdiction to sue, and claimed that preventing competitors from launching innovative products does not fall under the interests protected by the Commodity Exchange Act. HPC also mentioned that CFTC is working to bring on-chain trading, clearing, and settlement markets on public blockchains, including Hyperliquid, into the US regulatory framework.
