Several news agencies reported that a federal judge harshly criticized the U.S. Department of Justice for its "weaponization" practices on Monday and dismissed a case against two former FBI officials. The case alleged that the two had committed perjury to Congress regarding investigations related to Hunter Biden.

It is reported that Judge Cia Farouki of the United States District Court for the Federal District of Washington severely criticized the Department of Justice's prosecution of former officials Nicki Flores and Bradley Benavides as "careless" during the hearing, and expressed her "deep concern about what is happening here."

MS NOW reports that Farouki stated that the government lacks a reasonable basis and has not been able to produce evidence to prove that the statements made by these two officials to the House of Representatives Judiciary Committee in 2023 were knowingly false.

He also accused the Department of Justice of hastily advancing the case ahead of the mid-term elections. According to MS NOW, Farouki stated that this situation "cannot be described in any other way but as weaponization."

The judge even apologized to the government lawyers, stating that it was "extremely unfair" to ask them to defend such a flawed case.

"This doesn't feel like an investigation," Farouki reportedly added, "it's more like a broken, obsessive entanglement."

The Ministry of Justice did not immediately respond to the request for a comment from CNBC.

Later on Monday morning, the lawyers of Flores and Benavides praised the judge's ruling outside the court.

A lawyer from Flores said, "This case should never have been brought forward. As the judge just clarified, the government simply doesn't have a case at all." He also dismissed the prosecution as a "fever dream about a conspiracy involving Hunter Biden, akin to throwing spaghetti against a wall."

A lawyer for Benavides stated that they hope the Department of Justice does not attempt to keep the case alive by seeking prosecution from a grand jury, “where they can close the doors and shape the narrative, while we are unable to present our own position.”

The Ministry of Justice did not take this step when it announced the charges against Flores and Benavides on October 23rd.

On the contrary, despite the alleged improper conduct having occurred several years ago, the prosecution still obtained a criminal complaint form that only requires the signature of a judge. Criminal complaint forms are typically used to obtain an arrest warrant when the prosecution needs to act swiftly.

Farouki had previously raised objections to this practice and refused to sign a supplementary complaint last week, which added charges of obstruction of justice against these two former officials.

“I am concerned about your understanding of the law,” the judge said to the prosecutors at the hearing last Tuesday, “why today, in this case, have you changed the entire historical practice of prosecuting cases?”
